Abstract
يتمحور موضوع هذا البحث حول تسوية وضعية البنايات المشيدة بطريقة غير شرعية وكذلك الأوعية العقارية المشيدة عليها هذه البنايات قبل صدور القانون, 08/15 المؤرخ في 20/07/2008 في الجريدة الرسمية العدد 44 بتاريخ 03/08/2008, والذي يحدد قواعد مطابقة البنايات وإتمام انجازها. لأجل تسوية
هذه البنايات والأوعية العقارية المشيدة عليها.
حيث نتناول موضوع بعنوان: مجال تطبيق مطابقة البنايات وإتمام انجازها وتسوية وضعية الوعاء العقاري وفقا للقانون 08/15.
طرحنا الاشكال التالي : ماهي الاحكام التي تضبط مجال تطبيق تحقيق مطابقة البنايات وإتمام إنجازها؟ و ماهي اهداف تحقيق مطابقة البنايات؟ وماهي سبل تسوية البنايات الغير شرعية ؟ وسبل تسوية الاوعية العقارية المشيدة عليها؟
والذي تطرقنا في الفصل الاول الى تحديد مجال تطبيق تحقيق المطابقة المتعلقة بالبنايات , والأهداف والمبادئ المرجوة من تطبيق هذا القانون , و تناولنا في الفصل الثاني أحكام تسوية البنايات والوضعية القانونية للوعاء العقاري , ودور اللجان المتعلقة بدراسة والبت في ملفات السوية , وبعد ذلك تطرقنا إلى الإجراءات المتعلقة بتسوية الأوعية العقارية التي شيدت عليها هذه البنايات الغير الشرعية , بما فيها تحديد سعر التنازل وكذلك إعداد وتسليم عقد الملكية, وخلال دراستنا لهذا الموضوع خلصنا الى امكانية اعتبار احكام قانون تحقيق المطابقة هو اصلح للوضع الراهن في البلاد على البنايات الغير شرعية طالما ان النتيجة ستتعلق بتسوية مخالفات التعمير المرتكبة قبل نشر القانون 08/15.
وقد استنتجنا جملة من الاهداف شملتها هذه الدراسة من بينها, ترقية المواطن من صفته كحائز لبناية او/و للأرضية المشيدة عليها بطريقة غير شرعية الى مواطن ملتزم وخاضع لقوانين الدولة والسلطة الإدارية , والحد من انتشار البنايات غير شرعية , المحافظة على الاوعية العقارية من اجل انشاء مشاريع استثمارية وتنموية , الحد من غزو الاسمنت المسلح على الاراضي الفلاحية , والمحافظة على المظهر الجمالي للمدن و الاحياء السكنية بوجه عام .ومن خلال هذه الدراسة قدمنا بعض الاقتراحات التى نراها تساهم بشكل كبير في المحافظة على ترقية واستقرار المواطن وكذا المحافظة على النسيج العمراني للمدن عبر الوطن , وهي اعادة تمديد أجل هذا القانون لإعطاء فرصة لأصحاب البنايات الغير الشرعية لتسويتها , تدارك الأخطاء والهفوات التي وردت في بعض مواد هذا القانون محاولة إعادة النظر في السعر الأساسي للمتر المربع المتعلق بمبلغ التنازل على الأوعية العقارية التابعة لدولة وتمديد اجل تسديد مبلغ التنازل centered Multi this research about the settlement of the status of buildings built illegally as well as the receptacle Real Estate constructed by these buildings before the issuance of law, 08/ 15 of 20/ 07/ 2008 in the Official Gazette number of 44 on 03/ 08/ 2008, which determines the rules of matching buildings and the completion of completed. for the settlement of these buildings and receptacle Real Estate constructed on them. where we take Multi entitled: the field of the application of matching buildings and the completion of completed the settlement of the status of container real estate accordance with the law 08/ 15. we raised the shapes and follows: What are the provisions governing the field of the application of achieving the matching buildings and the completion of completed? and What are the objectives of achieving the matching buildings?
