Abstract: الملخص قواعد الضرر مهمة من حيث الخلفية والتطبيقات ، حيث تنظم المواقف التي تؤثر على العديد من جوانب حياة الشخص ، كلاهما الجسمانية والأخلاق وسيلة لحفظ حقوقه وصيانتها. يعتبر الفقه الإسلامي "قاعدة" الضرر من أكبرها القواعد التي تنطوي على قواعد مختلفة لمنع مثل هذا الضرر وحلها في أسوأ حالة. بالإضافة إلى المسؤولية المدنية ، تعتبر الأضرار عنصرا حاسما بالنسبة ل الحصول على تعويض. والضرر نوعان: مادي: يمس الإنسان في ماله أو ماله الجسد ، الأخلاق: الذي يؤثر على مشاعر الإنسان وشرفه ، وعلى أي حال يجب إصلاح هذين النوعين من الضرر. يشترك الفقه الإسلامي والقانون المدني في استخدام المصطلح نفسه "الضرر" ولكن تختلف في أحكام اللائحة. الدراسات الإسلامية السابقة عن الضرر الذي يقوم على أساس المبدأ التعويض عن الضرر دون دعم التعويض عن الضرر غير المادي ، في حين أن العديد من الدراسات الشرعية والإسلامية الحديثة ، بحثهم وقد ركز بشكل خاص على شرعية مبدأ التعويض عن ضرر معنوي. قوانين الأحوال الشخصية في الدول العربية مستمدة من الأحكام الشريعة الإسلامية والعديد من النزاعات المسجلة حول هذه القوانين تدور حولها الأضرار المعنوية المتعلقة بالطلاق والخطبة. نتيجة لما سبق ، فإن المشكلة الرئيسية لهذا البحث تدور حول شرعية التعويض عن الأضرار المعنوية بموجب أحكام الشريعة الإسلامية الفقه والقانون المدني وتطبيقاته الرئيسية في الأمور الشخصية الحالة بالسؤال التالي: ما حكم التعويض عن الضرر المعنوي في الشرع الاجتهاد والسوابق القضائية من القانون المدني وما هي تطبيقاته في أحكام قوانين الأحوال الشخصية؟Abstract in english The rules of the damage are important in terms of background and applications, where they regulate situations that affect many aspects of a person's life, both physical and morals and is a means of saving his rights and safeguard. Islamic jurisprudence considers the "rule" of damage one of the biggest rules involving different rules to prevent such damage and their resolution in the worst case. In addition to civil liability damages are considered crucial element for the acquisition of compensation. Damage is of two types: Material: affects a person in his wealth or his body, Morality: one that affects a person's feelings and honor, and in any case these two types of damage should be repaired. Islamic jurisprudence and civil law share the use of the same term "Damage" but are different on the provisions of the Regulation. The former Islamic studies about the damage that is based on the principle of compensation for damage without support of compensation for non pecuniary damage, while many modern legal and Islamic studies, their research has focused specifically on the legitimacy the principle of compensation for moral damage. The personal status laws in Arab countries are derived from the provisions of Islamic Sharia and many conflicts recorded about these laws revolve around moral damages related to divorce and engagement. As a result of the above, the main problem of this research turns around the legitimacy of compensation for moral damages under the provisions of Islamic jurisprudence and the civil laws and its main applications in matters of personal status by the following question: What provision of compensation for moral damage in Islamic jurisprudence and case law of civil law, and what are its applications in the provisions of the laws relating to personal status?
